Can A Surgeon Who Is Chief Of Staff At A Hospital Refuse Medicare Patients Legally?
I called a surgeon who is chief of neuro surgery at a local hospital to see about getting an appointment and was told he is not accepting medicare patients. Is this legal? It is my understanding that if the hospital accepts Medicare that a staff doctor must also. Has this rule changed?

If the doctor’s private practice is separate from the hospital where he has staff privileges, he can pick and chose his patients.
It is getting more and more difficult to find a physician who accepts Medicare. Congress should do something about this.

Each MD is only allowed to have a maximum of so many medicaid and medicare patients and then they can’t accept anymore..even if they want to and most don’t want to.. Medicare pays about 50% of what MD’s actually charge and it takes several months for the govt to pay.. MD’s don’t want to deal with that..
Bush is making further cuts in Medicare payments. He’s cutting all MD payments by medicare another 10% so a LOT more MD’s will refuse to take it..

If it is an emergency, they are required to treat you in order to stabilize the patient. Is your case an emergency???
Call the hospital and ask to speak to a social worker. They will try to help you.

Any doctor or hospital can rufuse you. Unless it is a life emergency, then they only ave to get you stable and send you on you way.

Are you trying to make an appointment with his private practice? If so, you can refuse to accept medicare patients.
