Can You Sue A Hospital And Staff For Assault?

I was illegally restrained against my will during a hospital stay. Can i sue for pain and suffering?

    it depends… was you a threat to the hospital staff? if you were No you can’t… and most likely you couldn’t anyways because they will have an legal reason for doing so and the proof of them lieing lies on your shoulders and if you can not prove any different then you are just SOL>…..

    Sure you can. Hospitals and there staff are not immune from lawsuits. As long as you have facts to back up your claims then you can sue them for anything you want. Just find yourself a really good attorney and you should be ok.

    well- it depends why they wr restraining you. Were you on drugs? depedns on the situaion- if it’s valid then yes! eityher way- it’s not pain & suffering. Pain & suffereing refers to physical trauma- suffering refers to going though a period of pain for a long time

    If there was an assault then you can sue. Assault is a term of art in the law and you should consult a lawyer in or near the city where the hospital is located.

    You can sue anyone for anything. Whether you win or not is a completely different manner.
    You do not give nearly enough details for anyone to answer this properly. Why were you in the hospital? Why were you restrained? My guess is that you were a danger to yourself and others… most hospitals don’t go around restraining people for no good reason.
    Exactly what pain and suffering did you suffer? How long were you restrained? What pain happened? Were you cut or bruised? Were you permanently damaged?
    I would suggest looking at the situation through the doctors/nurses eyes and determining exactly what you did to warrant such action. Then I would suggest not repeating the offense. I would not suggest suing unless you can PROVE that you were unlawfully and unreasonably restrained AND that it caused lasting physical and emotional damage (which I seriously doubt).

    A lawyer would be able to give you a better answer, especially since every jurisdiction has different laws. I suugest you contanct legal aid or any lawyer in your area if you want accurate information.

    1st constitutional right, able to sue and bear armes, get over it , sue your neighbors dog for crapping on your lawn, because it devalued the property, that’s why our insurance is so high because every one sues, for needless things, ill sue you because I’m emotionally upset with your problem….

    You need to be honest with yourself. Hospitals dont go around illegally kidnapping and restaining patients – unless the patients are a danger to themselves or others. It is highly likely that you were a danger to someone, so you were restrained.
    Why is everyone so litigious in this country? Should the hospital be allowed to sue you for being a pain in the azz to care for??
