Fired while 35 weeks pregnant?

Discount Medical Scrubs

The morning of the day of my termination I woke up to swollen feet. I work at a medical records office, which is closed off to the public and its usually always the same people there. I decided to wear flip flops with my scrubs because I knew that if I put on socks and sneakers the situation would get worse. On fridays and sundays we are allowed to wear casual clothing and flip flops if we wanted to. So I didn't think it was a big deal for me to wear them because of my swollen feet. Also, I have a good personal and professional relationship with all of my managers so i figured they would understand. I go in that morning and go about my daily duties as a trainer (which keeps me on my feet all day). I had clocked in at 8:30. Since im close to the end of my pregnancy I use the bathroom a lot more. I had gotten up twice passing my boss' office. When I go into the scanning room my boss' brother looks down at my feet and smirks. I shrug it off and go back to my desk. At 9:30 am my boss approaches me and asks "What are you wearing?" and I proceeded to explain why I was wearing flip flops but he cut me off and said I must go home. and that I should have worn Crocs or something. I was trying to tell him I did not have the money to buy anything else and that I tried to make the best of the situation that morning so I can come to work. I previously asked a co worker whom was pregnant while working at this job about 2 years ago what she had wore and she told me she wore some cartoon bedroom slippers, so I didnt think I was doing anything wrong. So I go home and decide to rest I woke up around 3pm and realized I missed a call from my boss and I called him back. He had called me 5 mins before I realized I missed his call. As soon as I answer he tells me that "they" (him and his aunt who is the manager for the site and made him manager of the office) decided to terminate me. He then tells me very rudely that I should have gone into a store and bought some cheap little sandals or something???? I was very distraught and began to cry and ask him why he is doing this. He continued to be rude about it and I was getting very tense and ill and hung up. I was completely shocked because up until then things were fine at the job and even the managers were looking forward to go to my baby shower. So for this sudden termination and disrespect, it had me torn. I was so close to being on my maternity leave i didnt understand why they would even fire me. There is alot to this story and the way these people do things but to shorten this up. I filed for unemployment and was denied. A lady contacted me and told me I was denied because of misconduct at the workplace and because I was pregnant i wouldnt be able to work anyways!!!! I just want some opinions on what I should do when this happened I was going throught a lot and didnt attempt to do anything it has been 7 months and I have gathered more info and actual employees who have seen the wrong doings these people do. Should I take legal action? Do I have a case? thanks.
I live in Florida. My fiance who works there asked why I was fired and they said because I abandoned the workplace. He said I was supposed to come back but, I was never told to come back. I never received a previous warning or suspension. So basically its their word against mine. They have some personal issues with me and have previously gossiped and have set me up as well as other people. Im only 21 at the time I was 20. I believe they will set me up, because they know they have done wrong. This company is run my family so I cannot go to HR or the Ceo.

I am surprised you are EVER allowed to wear flip flops at work. That is so dangerous it isn’t even funny. That is a bizarre company that would allow that any day of the week.

However, you were sent to go change your shoes, not to take the day off work.

I would have to agree, this is job abandonment, not having anything to do with being pregnant, but having to do with you just up and going home for the day.

You are right, it is their word against yours, it boils down to were you or were you not at work. You seem to be in agreement on that issue, the only issue. You went home and decided to take a nap.

yes, u have a case, they can not fire U.

i dont know what state u live in….but in california its illegal to fire someone while they are pregnant. so yes i would say u have a case…..its discrimination.

It seems it may be worth it to contact a lawyer and discuss with them.

They can fire any employee they wish, for no reason at all…they just cannot fire you BECAUSE you are pregnant.Flip flops were obviously not appropriate to wear to your job.Own up to your mistake and stop crying victim. You cannot base your actions off something that happened two years ago.

Now, the fact that they lied and said you ”abandoned the workplace” which is false when they told you to go home, is something that you have on your side.I would apply for unemployment again.

wow!! im so sorry to hear about this!! makes me angry and sad :(
first off im so glad you do not work for them anymore!! you are much better than that :)
and yes you DO have a case!!
its discriminatory on their behaf, not to mention, they need to give you 2 weeks notice, unless you did something horrific there, and flip flops is NOT horrific lol
good luck hon!! now go kick their butts!! :)

  7. Heather Says:

I seriously think you have a case. Look into it.

  8. krystal t Says:

ok 1st off he did send you home, and if he sent you home to change your shoes then he should have told you that but instead he just told you to go home, so you DID NOTabandon work, and they DO have to give you two weeks notice, so you DO have a case against them, and 2 the flip flops are all you had, and most people in the us like me and my husband dont even have a dollar to our name to get shoes with, so fireing you is something they WERE NOT able to do.
